§ 1

Exclusion of Withdrawal for Commercial B2B Contracts (§ 14 BGB)

Darezini Naturdärme GmbH operates exclusively as a commercial wholesale manufacturer and supplier to business clients, meat packaging corporations, and food processing enterprises (entrepreneurs within the meaning of Section 14 of the German Civil Code, BGB). Under German statutory law, the 14-day distance withdrawal right pursuant to Sections 312g and 355 of the German Civil Code (BGB) is granted exclusively to consumers (Verbraucher within the meaning of Section 13 BGB). Consequently, commercial enterprise clients have no statutory right of withdrawal once an order confirmation is issued and binding commercial agreement is formed.

Statutory Exclusions for Food, Perishables & Hygiene (§ 312g(2) BGB)

Even in the hypothetical event that a transaction were classified as a consumer contract under Section 13 BGB, statutory withdrawal rights are categorically excluded pursuant to Section 312g Paragraph 2 of the German Civil Code (BGB) for the following classes of goods: • Perishable Goods (§ 312g(2) No. 2 BGB): Contracts for the supply of goods that are liable to deteriorate or expire rapidly. Natural casings are biological, temperature-sensitive animal products requiring continuous cold-chain management. • Sealed Hygiene & Health-Protection Products (§ 312g(2) No. 3 BGB): Contracts for the supply of sealed goods which are not suitable for return due to health protection or hygiene reasons once their seal (cask seal, tamper-evident band, or vacuum barrier) has been removed after delivery. • Tailored Calibers & Custom Production (§ 312g(2) No. 1 BGB): Natural casings prepared according to individual customer caliber specifications, spooling formats (taped, tubed, or brine-packaged).
